1. Acceptance of Terms

By downloading, installing, or using ClearCut (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms apply to all users of the App and the ClearCut website at clearcut.pro (the "Website").

2. Description of Service

ClearCut is a native macOS application that provides 41 professional media processing tools across video, audio, image, and PDF categories including compression, conversion, trimming, cropping, merging, watermarking, GIF creation, audio extraction, background removal, PDF encryption, and more. All processing is performed locally on your device.

3. License and Usage

ClearCut grants you a limited, non-exclusive, non-transferable, revocable license to use the App subject to these Terms:

• Free Tier: The free version of ClearCut provides access to core features with certain limitations (e.g., watermarked output, file size limits). You may use the free version for personal and commercial purposes.
• Pro License: ClearCut Pro unlocks all features and removes limitations. Pro licenses are managed through Apple's In-App Purchase system and are subject to Apple's terms and conditions.

4. User Obligations

You agree to:

• Use the App in compliance with all applicable laws and regulations
• Not use the App to process, download, or distribute content that infringes on intellectual property rights
• Not reverse engineer, decompile, or disassemble the App beyond what is permitted by law
• Not use the App in any manner that could damage, disable, or impair the App
• Ensure you have the right to process any content you use with the App

5. Video Download Feature

ClearCut includes a video download feature powered by yt-dlp. You are solely responsible for ensuring that your use of this feature complies with the terms of service of the respective video platforms and applicable copyright laws. ClearCut does not host, store, or distribute any downloaded content. We encourage users to only download content they have the right to access and save.

6. Third-Party Dependencies

ClearCut bundles open-source tools including FFmpeg and yt-dlp within the application. These tools are governed by their own licenses (FFmpeg under LGPL/GPL, yt-dlp under The Unlicense). ClearCut is not responsible for their operation or any issues arising from their use.

7. In-App Purchases and Refunds

ClearCut Pro is available as an In-App Purchase through the Apple App Store. All purchases are processed by Apple and are subject to Apple's refund policies. To request a refund, please contact Apple directly through their standard refund process at reportaproblem.apple.com.

8. Intellectual Property

The ClearCut App, including its design, code, branding, and documentation, is the intellectual property of ClearCut. You retain full ownership of any content you create or process using the App. ClearCut does not claim any rights over your content.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEARCUT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or us. You may stop using the App at any time by uninstalling it from your device.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised date. Your continued use of the App after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be resolved through good-faith negotiation before pursuing formal legal proceedings.
